These Terms of Service ("Terms") govern your use of the Ascendify mobile application ("Ascendify," "the App," "we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
Ascendify is an iOS application that uses artificial intelligence to analyze a photo of your face and return descriptive scores and self-improvement suggestions ("looksmaxxing" guidance) related to features such as jawline, cheekbones, eyes, skin quality, symmetry, and overall facial harmony.
Ascendify is provided for entertainment and self-improvement purposes only. It is not a medical, dermatological, psychological, dental, or surgical service, and the output does not constitute professional advice of any kind. See Section 8 (Disclaimers) for full detail.
You may use Ascendify only if:
Ascendify is not intended for, and is not directed at, children under 13. We do not knowingly collect data from children under 13. See our Privacy Policy for detail.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App on Apple-branded devices you own or control, solely for your personal, non-commercial use. This license is granted by Ascendify and not by Apple Inc.
You may not:
Full face analysis, personalized routines, scan history, and progress tracking require an Ascendify Pro auto-renewing subscription, billed through your Apple ID.
All purchases are processed by Apple. Refunds are subject to Apple's policies. To request a refund, use Apple's refund process at reportaproblem.apple.com. We do not directly process refunds.
We may change subscription prices from time to time. Material price changes will be disclosed to you in advance through Apple's subscription pricing change flow, and you may accept or cancel before the new price takes effect.
Ascendify's scores, ratings, observations, and daily routine suggestions are generated by artificial intelligence (Google's Gemini model, accessed through our servers). AI output:
You are responsible for evaluating AI output critically and exercising your own judgment before acting on any suggestion.
When you submit a photo for analysis, you represent and warrant that:
We do not retain your photos on our servers after analysis is complete. See our Privacy Policy for the full data-flow description.
You retain all ownership rights in photos you submit. You grant us a limited, non-exclusive license to process the photo solely for the purpose of returning an analysis to you. This license terminates as soon as the analysis is returned.
Ascendify saves your scan history (photo + analysis results) to your own iCloud Drive container ("iCloud") when iCloud is available, or to local device storage otherwise. We do not have access to your scan history; it remains in your control. You can delete individual scans, or use the in-app account deletion flow to wipe all data.
Ascendify is not a medical, psychological, dermatological, dental, or surgical service. Scores, observations, and suggestions provided through Ascendify are not, and must not be construed as:
Always consult a qualified professional before making changes to your skincare regimen, diet, exercise, sleep, or any other health-related practice. Discontinue any practice that causes pain, discomfort, or adverse symptoms, and seek professional care.
The App is provided "as is" and "as available," without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or availability. We do not warrant that the App will be uninterrupted, error-free, or that any AI output will be accurate or appropriate for your circumstances.
To the maximum extent permitted by applicable law, in no event shall Ascendify be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the App, regardless of legal theory and even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for any claim arising out of or related to these Terms or the App is limited to the greater of (a) the total amount you have paid us for the App in the twelve (12) months preceding the claim, or (b) twenty U.S. dollars (US$20).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the smallest extent permitted by law.
You agree to indemnify, defend, and hold harmless Ascendify from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any applicable law or any third-party right; or (d) any content you submit through the App.
You may stop using the App at any time and delete your account from within the App (Profile → Account → Delete Account).
We may suspend or terminate your access to the App at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law, or if we discontinue the App.
Sections 5, 6, 8, 9, 10, 11, 13, 14, and 15 survive termination.
We may update these Terms from time to time. When we do, we will update the "Effective date" at the top and, for material changes, provide reasonable notice (such as a notice in the App or on our website). Your continued use of the App after the effective date constitutes acceptance of the updated Terms.
You and we acknowledge that these Terms are between you and Ascendify only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, that you paid for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
You and we acknowledge that Ascendify, not Apple, is responsible for addressing any claims relating to the App or your possession or use of it, including: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
You and we acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Ascendify, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such infringement claim.
You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not on any U.S. Government list of prohibited or restricted parties.
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be brought exclusively in the state or federal courts located in the State of Washington, and you consent to the personal jurisdiction of those courts.
If you are a consumer in the European Union, United Kingdom, or another jurisdiction whose mandatory consumer protection laws afford you stronger rights, nothing in this Section overrides those rights.
